Draft terms — legal review required
These Terms and Conditions are a draft for the CreatX Digital website and must be reviewed by qualified legal counsel before publication. They are not legal advice. The owner must confirm the contracting legal entity, business address, governing law, and dispute forum. No jurisdiction is established by the business telephone number or website domain.
Using this website
These terms explain the intended conditions for using creatxdigital.com. Use the website lawfully and only for legitimate information or business inquiries. If you do not agree to the published terms, do not use the website. Mandatory legal rights that cannot be excluded remain unaffected.
Services, proposals, and project agreements
Website descriptions explain the types of creative, development, automation, publishing, and digital-product services CreatX Digital may provide. They are not a binding offer, a guaranteed result, or a commitment that every feature is included.
The specific scope, deliverables, schedule, price, responsibilities, and acceptance criteria are established in a written proposal or project agreement accepted by the parties. An inquiry or automated receipt does not create a project agreement. In the event of a conflict, the signed project agreement governs the work it covers, subject to applicable law.
Payments and deposits
Fees, currency, applicable taxes, deposits, milestone payments, and the final payment date are specified in the project agreement. Work begins according to the agreed payment and approval conditions. No fixed deposit percentage, refund rule, or late fee is imposed by this draft.
Third-party costs such as hosting, domain registration, platform subscriptions, licenses, stock media, transaction fees, and usage charges are separate unless expressly included. Any consequences of nonpayment, cancellation, or a pause must be agreed in writing and comply with applicable law.
Client responsibilities
Clients must provide accurate requirements, lawful content, necessary access, timely feedback, and a person authorized to approve the work. Clients are responsible for permissions covering material they supply, including logos, text, photographs, footage, customer information, and other assets.
Clients must review final business claims, prices, policies, specialist information, and legal or regulatory statements before approval. Required educational, financial, medical, or other specialist review is not included unless expressly agreed with a qualified provider.
Feedback, revisions, and changes
The project agreement identifies the number and type of revision rounds included. Feedback should be consolidated and provided at the agreed milestones. New deliverables, additional versions, changed requirements, or a change to an approved direction may require a revised fee or timeline.
Changes outside scope are documented and approved before the additional work begins. The agreement should identify what happens when feedback or approval is delayed.
Timelines and dependencies
Schedules are planned from the agreed scope, available assets, approvals, access, and third-party dependencies. Delayed information, added requirements, platform restrictions, or events outside reasonable control can affect delivery. Material changes to the schedule should be communicated and agreed promptly.
A target launch date is not a guarantee unless the signed project agreement expressly makes it binding and sets out the relevant conditions.
Third-party platforms and services
External software, hosting, plugins, marketplaces, email services, fonts, media, and integration providers are governed by their own terms, licenses, charges, and availability. Supported connections depend on technical feasibility, permissions, account plans, and provider policies.
CreatX Digital does not control changes, outages, approval decisions, or account restrictions imposed by those providers. Responsibility for account ownership, billing, maintenance, and renewal should be stated in the project agreement.
Intellectual property and handover
The project agreement defines ownership of final deliverables, any rights assigned or licensed, payment conditions, source files, and handover access. Unless the agreement says otherwise, no rights transfer is implied merely by submitting an inquiry, receiving a proposal, or viewing work in progress.
Pre-existing tools, methods, reusable components, and third-party materials may remain the property of their respective owners and be supplied under a license. Clients must comply with the licenses for fonts, stock media, software, and other incorporated materials.
Portfolio display
Use of a client’s name, logo, final work, or project details in a portfolio is subject to the project agreement and any confidentiality restrictions. Any necessary approval must be obtained before display.
Concept Projects and Capability Showcases on this website are illustrative design studies. They must not be treated as verified client engagements, testimonials, or evidence of commercial results.
Confidentiality
Any confidentiality obligations, permitted disclosures, duration, and security requirements should be documented in the project agreement or a separate confidentiality agreement. Information should be shared only with those who need it for the agreed work and are subject to appropriate obligations.
Do not submit trade secrets, credentials, or highly sensitive information through the public inquiry form. A separate secure exchange can be agreed where necessary.
Availability and support
Reasonable efforts are made to keep website information useful and current, but pages and functionality may change or become temporarily unavailable. The website may be interrupted for maintenance, technical issues, or events outside reasonable control.
Post-launch maintenance, response arrangements, backups, security updates, and support are included only to the extent stated in an applicable agreement. Website browsing itself does not create a support commitment.
Prohibited conduct
Do not use the site to send unlawful, abusive, deceptive, or infringing content; impersonate another person; harvest personal information; introduce malware; interfere with operation; or attempt to bypass security, access restrictions, or submission limits.
Access may be restricted where reasonably necessary to protect the website, users, or legal rights, subject to applicable law.
Warranties and outcomes
Except for commitments expressly made in a project agreement and rights that cannot legally be excluded, general website content is provided for information without a promise that it will be complete, continuously available, or suitable for every purpose.
Creative work, websites, automation, and digital products do not carry a guaranteed sales, revenue, ranking, traffic, conversion, or platform-approval result. Any project warranties and remedies must be stated in the written agreement and remain subject to applicable law.
Limitation of liability
Any limitation or exclusion of liability must be reasonable, lawful, and expressly set out in the applicable agreement. This draft does not invent a monetary liability cap or exclude responsibility that cannot be excluded under the governing law.
To the extent permitted by applicable law, losses caused by reliance on general website information or by third-party services may be subject to exclusions in the final, legally reviewed terms. Nothing in the published terms should limit liability for fraud or any other liability that the law prohibits limiting.
Suspension and termination
Either party’s rights to pause or end a project, notice requirements, payment for completed work, treatment of deposits, file handover, and continuing obligations must be defined in the project agreement. Ending a project does not automatically cancel accrued obligations or rights that are intended to continue.
A project may require a revised schedule or scope after a prolonged pause. Any restart arrangements should be agreed in writing.
Governing law — owner confirmation required
Governing jurisdiction: NOT YET CONFIRMED. The owner must confirm the applicable country or state law and dispute forum with qualified legal counsel before publication or use of these terms in an agreement.
No jurisdiction is inferred from the +1 telephone number, the website’s domain, the location of visitors, or the currencies used in a proposal. Applicable mandatory consumer and data-protection rights must be preserved.
Changes to these terms
The website terms may be updated to reflect changes in the site or business. The legally reviewed published version should include an accurate effective date. Changes to a signed project agreement require the method of agreement specified in that contract; a website update alone does not rewrite it.
